In a recent BYOD (Bring Your Own Device) case, Cochran vs. Schwan's Home Services, Inc., it was ruled that in order to be compliant with California Labor Code section 2802 an "employer must pay some reasonable percentage of the employee’s cell phone bill" if the use of a cell phone is deemed "mandatory" by the employer.
We strongly recommend that a Team Member's use of Forge through the mobile app be optional for your employees. Making this optionality clear in any communications or policies held by the company is in the best interest of the company.
